Editors Christoph Herwartz and Teresa Stiens on the Data Act and the control of car data for consumers

“Whoever buys a device also has the right to use the data it generates. What sounds self-evident is not yet the case. The data sets that a modern car constantly generates are often only accessible to the manufacturer. The Data Act only stipulates: Whoever develops a product must ensure that the data generated during use are accessible. At the user’s request, the data owner must make the data available as quickly as possible, possibly even in real time. The user may also demand that the data be passed on to a third party as quickly as possible. These third parties may only use the data for the purposes for which they received the data.”
